  • Search EUIPO database (euipo.europa.eu) and TMview for existing marks
  • Determine if your mark is word, figurative (logo), or shape
  • Select Nice Classification classes and goods/services descriptions
  • Use pre-approved descriptions from EUIPO harmonised database for Fast Track

Post-Brexit note: An EUTM does NOT cover the UK. File separately at UKIPO for UK protection.

  • Go to EUIPO online filing system (euipo.europa.eu)
  • Select Fast Track if using pre-approved descriptions
  • Enter the mark — word mark, figurative mark, or shape mark
  • Select Nice Classification classes and goods/services
  • Pay fee: €850 for one class, +€50 second class, +€150 each additional
  • Submit application
  • Examination: ~1 month
  • Publication for opposition: 3-month period
  • If no opposition: registration issues (~5 months total from filing)
  • Save registration certificate

Fast Track: If you used pre-approved descriptions and paid online, registration can complete in under 4 months if unopposed.

Pitfalls to Avoid

Assuming UK Coverage

Since Brexit, an EU Trade Mark no longer covers the UK. If the UK is an important market, file a separate application at UKIPO or use the Madrid System to designate the UK.

Non-Standard Descriptions

Using custom goods/services descriptions instead of pre-approved ones disqualifies you from Fast Track processing, adding months to the timeline. Use the EUIPO harmonised database wherever possible.

Ignoring the Opposition Period

The 3-month opposition period is real — existing trademark holders can and do oppose new filings. Search thoroughly before filing to avoid costly opposition proceedings.
