A utility model is registered without examination — its validity is untested until challenged. Before enforcing against an infringer, obtain a search report or opinion on validity. Courts may be sceptical of unevaluated rights.
No Grace Period
Unlike the US (12-month grace period), Germany requires absolute novelty. Any public disclosure before filing — trade shows, publications, social media — destroys novelty and invalidates the utility model.
